These rules apply to your use of the NEAR app, made of play ideas for parents and children. Please read them carefully: by creating an account or continuing to use the app, you agree to them.

1. Who we are and what these Terms are

NEAR is an app offered by Liga Labs (DAVISON PATROCINIO CARDOSO, MEI), registered under CNPJ No. 69.627.558/0001-06, headquartered at Ipatinga, MG, Brazil ("we"). Our website is ligalabs.com/near.

These Terms of Use ("Terms") explain the rules for using the app and its features. They work together with the Privacy Policy, which explains how we handle personal data.

If you do not agree with the Terms, do not create an account and do not use the app.

2. What NEAR is

NEAR gathers play ideas, step-by-step guides, themes, tips and printable materials so that parents and guardians can play with children. We update the catalog and the content over time.

Using NEAR requires NEAR Access, a paid access purchased on the Bigbot platform (see section 6). NEAR has no free plan and shows no ads. NEAR can be used on Android (downloaded from Google Play) and in the browser at near.ligalabs.com, with the same account.

3. Who can use it

NEAR is meant for adults: parents, legal guardians and educators. To create an account you must be at least 18 years old and legally able to accept these Terms.

Children do not create accounts and should not use the app alone. Activities are done by you, together with the child, under your supervision.

If you add a child profile, you declare that you are the child's parent or legal guardian, or that you have authorization from one.

4. Your account

For some features you create an account with e-mail and password or sign in with Google (Apple sign-in is planned). You must give true information and keep it up to date.

You are responsible for keeping your password safe and for everything that happens in your account. If you suspect misuse, change your password and let us know through the contact channel.

You can edit your data and delete your account at any time in the app, under Profile › Privacy and data.

5. Safety during activities

The activities are general suggestions for leisure and family time. They do not replace your own judgment. Before playing, check whether the activity suits the child's age, development and health and the place where you are.

You are responsible for supervising the child during the whole activity, choosing safe materials and protecting the child from risks such as small objects, non-toxic paints and materials, heat, water, allergies and falls.

NEAR content is informational and recreational. It is not medical, psychological, educational or therapeutic advice.

6. NEAR Access

Using NEAR requires NEAR Access. There is no free plan and NEAR shows no ads.

NEAR Access is obtained through a one-time purchase on the Bigbot platform, at ligalabs.bigbot.com.br, in one of two ways: bought directly (through the link on our website) or as a bundle together with a digital product (course/e-book) also sold on Bigbot. The purchase unlocks all of NEAR (all content and printables) for 12 months from activation. The price and currency are shown on the Bigbot page before you confirm.

Payment is charged and processed by Bigbot, not by us, and we never receive your card data. Nothing is bought inside the app.

NEAR Access does not renew automatically, so there is nothing to cancel: if it is not extended, access simply ends at the end of the 12-month period and the content stays blocked until you buy a 12-month extension, also on Bigbot. Your account and data remain until you delete the account.

Refund requests follow Bigbot’s rules and applicable law, including the 7-day right of withdrawal for online purchases (art. 49 of the Brazilian Consumer Defense Code). You can ask for it through Bigbot or through our contact page. If the purchase is refunded, NEAR Access is removed.

Purchases are made by an adult on the Bigbot page. Deleting your account ends NEAR Access. Purchase records may be kept by Bigbot and by us for the period required by tax law.

7. Intellectual property and license

The app, the NEAR brand, the texts, illustrations, photos, catalog and other materials belong to us or to those who license them to us, and are protected by intellectual property law.

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the app and to print materials for family, non-commercial use.

• Do not copy, sell, rent, distribute or publish NEAR content outside personal and family use.
• Do not reverse engineer the app, do not try to bypass protections of the app, or of NEAR Access, and do not use bots or automated data collectors.

8. Proper use

By using NEAR, you agree not to:

• use the app for illegal purposes or to harm other people;
• try to access other people's accounts, systems or data without authorization;
• interfere with the operation of the app, of our servers or of the networks connected to them;
• send false information when creating an account or contacting us.

9. Availability and changes to the app

We work to keep the app available, but it may be unavailable because of maintenance, internet failures, third parties (app stores, the Bigbot platform, sign-in and hosting providers) or reasons beyond our control.

We may add, change or remove content and features, including what is included in NEAR Access. When a change significantly affects something you bought, we will give reasonable notice.

10. Limitation of liability

The app and the content are provided as they are. To the fullest extent allowed by law, we are not liable for indirect damages or for incidents resulting from activities carried out without the supervision or care described in section 5.

Nothing in these Terms excludes or limits rights that the law gives you as a consumer, nor our liability where it cannot be limited by law.

11. Privacy and data protection

The handling of personal data is governed by our Privacy Policy, in accordance with the Brazilian General Data Protection Law (LGPD, Law No. 13,709/2018). Children's profiles (name, age and optional photo) stay only on your device.

You can see both documents at any time under Profile › Privacy and data.

12. Termination

You may stop using the app and delete your account whenever you want. We may suspend or end the access of anyone who breaches these Terms or the law, or when the service is discontinued, giving notice whenever possible.

After termination, the rules that by their nature should remain in force continue to apply (for example, intellectual property and limitation of liability).

13. Changes to these Terms

We may update these Terms. The current version is always the most recent one, identified by the date at the top of the document. For relevant changes, we will ask you to read and accept again when you open the app.

Continuing to use NEAR after an update means you agree to the new version.

14. Governing law and jurisdiction

These Terms are governed by the laws of Brazil. The courts of the consumer user's place of residence are chosen to settle any matter related to them, as provided by the Consumer Defense Code.
